Foreclosures
The legal process by which an owner’s right to a property is terminated, usually due to default. Typically involves a forced sale of the property at public auction, with the proceeds being applied to the mortgage debt.
Orange County
Effective November 7, 2011, motions and orders for sale cancellation must be filed with the Clerk’s office no later than 4 p.m. the business day before the scheduled sale date. For cancellation requests on the actual sale date, counsel must appear before the Judge at 9 a.m. to seek cancellation of the sale.
If a hearing is set by an attorney on Wednesday without coordination with opposing counsel and the foreclosure court specialist, the hearing will be cancelled by the Court.
When a motion and order is e-filed, it is automatically sent to the Judicial Assistant in the division to which the case is assigned. Your motion and order will then be electronically reassigned to Marjorie Pemberton, the Court Program Specialist in the Foreclosure division. If you e-file your document, please do not send a courtesy copy to the Judicial Assistant, Clerk’s Office, or Marjorie Pemberton in the Foreclosure division.
Non-Commercial Foreclosure Cases/Lien Foreclosures

Effective July 1, 2011, there will be One Division to handle Non-Commercial Foreclosure Cases from all Circuit Civil Divisions (32A, 33, 34, 35, 37, 39, 40, 43A).
Monday, Tuesday, and Thursday – Hearings on motions for summary judgment and other short motions will be heard at 9 a.m. and 1:30 p.m. Attorneys do not need to schedule hearings/motions. The hearings/motions will be heard on a first-come-first-serve basis at 9 a.m. and 1:30 p.m.
Wednesday – Timeshare foreclosure cases will be heard from 9:00 a.m. – 10:00 a.m. Timeshare cases will be heard on a first-come-first-serve basis. 10:00 a.m. – Noon and 1:30 p.m. – 5:00 p.m. will be reserved for scheduled contested hearings. Please contact Marjorie Pemberton to schedule the contested hearings.
Trials will be handled by the Circuit Civil Division to which the case is assigned.

Osceola County
Non-Commercial Foreclosure Cases/Lien Foreclosures

Effective July 12th, 2011, Division C will handle Non-Commercial Foreclosure Cases from Circuit Divisions (22E, 20B).
Tuesday and Wednesday - Law firms must obtain a password in order to set the hearings. You may contact the Court Administration IT Help Desk Office by e-mail in order to obtain a password at help_osceola@ocnjcc.org. Once you obtain your password you may start scheduling hearings. To access available hearing time, visit the division’s website at http://foreclosure.ninthcircuit.org.
Time slots from 9:15 a.m. to 11:00 a.m. are set for summary judgment motions that are uncontested or pro se (no opposing counsel) only. You click on the “Request a summary judgment hearing” button to set these hearings. If there is any other type of motion involving opposing counsel, a 10 minute time slot must be selected. You click on the “Request a special set hearing” button to set these hearings
Important: The original notice of hearing must be promptly filed with the Osceola Clerk of the Court. Failure to file the notice of hearing will cause your case not to be part of the docket in which case your case will need to be reset. Please remember that the Foreclosure Division does not have telephonic appearances for any of our hearings; attorneys must be present or have local counsel present.
Resetting or Cancelation of Foreclosure Sales - All emergency motions to cancel or reset foreclosure sales must be faxed directly to the Clerk’s office at: (407) 742-3652.
Cancellation of Hearings - In the event that you need to cancel a hearing, please fax the notice of cancellation of hearing directly to the Clerk’s Office at 407-742-3652. The Clerk’s phone number for Civil/Foreclosure matters is 407-742-3479.
